1. Acceptance of terms and conditions
The customer acknowledges having read, at the time the order is placed, the special conditions of sale set out on this screen and expressly declares that he accepts them without reservation. The present general conditions of sale govern the contractual relations between the company AIX ET TERRA and its customer, both parties accepting them without reserve. These general conditions of sale will prevail over any other conditions appearing in any other document, unless prior, express and written derogation.
2. Products
Photographs illustrating the products, do not enter into the contractual field. If errors have been introduced, under no circumstances can the company AIX ET TERRA be held responsible. All the products offered to its customers by the company AIX ET TERRA are available in our warehouse.
3. Order
Automatic recording systems are considered as proof of the nature, content and date of the order. The company AIX ET TERRA confirms the acceptance of the order to the customer at the e-mail address provided by the customer. The sale will only be concluded once the order has been confirmed. The company AIX ET TERRA reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. The information given by the buyer when taking the order is binding: in the event of an error in the wording of the addressee's details, the seller cannot be held responsible for the impossibility of delivering the product.
4. Delivery
After confirmation of the order, the company AIX ET TERRA undertakes to deliver to its carrier, all the references ordered by the buyer within a maximum period of 48 working hours. This carrier undertakes by contract with the company AIX ET TERRA to deliver the order to the address of the buyer supplied by the company AIX ET TERRA. In the case of transport in a system known as cash on delivery, the customer undertakes to pay the carrier or his representative the totality of the sum indicated at the time of the confirmation of the order. In addition, for deliveries outside metropolitan France, the customer undertakes to pay all taxes due on the import of products, customs duties, value added tax, and all other taxes due under the laws of the country in which the order is received. The company AIX ET TERRA declines all legal responsibility if the payment of taxes is not made by the customer.
The delivery will be made by La Poste in colissimo suivi. The delivery is carried out in the time slot provided with the customer by the direct delivery of the product to the announced addressee, or in case of absence, to another person authorized by the customer.
Deliveries in the EEC countries are made by La Poste in Colissimo suivi Europe or Chronopost according to the customer's choice, for deliveries outside the EEC deliveries are made by the international postal services or Chronopost according to the customer's choice. In case of apparent defects, the buyer has the right to return the goods under the conditions provided for in this document.
War, riots, riots, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure discharging the seller from his obligation to deliver.
Always check your package upon arrival. You have 48 hours to make any reservations to the carrier in case of missing or damaged. For reasons of availability, an order can be delivered in several times to the customer. The customer then pays for only one delivery. If the customer wishes 2 places of delivery, he places 2 orders, with the related delivery costs.
5. Withdrawal
You have 14 days (from the reception of the articles) to make you an opinion. In case of exchange or refund, return the new item(s) in their original packaging, intact, accompanied by all accessories, instructions and documentation to the following address:

In the event of exercising the right of retraction, the company AIX ET TERRA is obliged to reimburse the sums paid by the customer, free of charge. Reimbursement is due within a maximum period of 14 days.
6. Awards
The price is expressed in euros. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France and EEC countries. This price includes the price of the products, the handling, packaging and conservation of the products, the transport costs.
7. Payment
The price invoiced to the customer is the price indicated on the order confirmation sent by the company AIX ET TERRA.
The price of the products is payable in cash on the day of the effective order.
Payment is made by credit card bearing the CB logo. Payment can also be made by Paypal or by cheque made out to AIX ET TERRA.
On line MERCANET allows you to pay via the BNP PARIBAS bank server in a secure environment. Your credit card number is thus directed towards the servers of the bank, your payment is carried out directly at the bank in a protected environment without passing by the waiter of our shop, guarantee all the more important as your Numbers are known only by our banking partner (BNP PARIBAS).
The order validated by the customer will only be considered effective when the bank payment centres concerned have given their agreement. In case of refusal of the said centres, the order will be automatically cancelled and the customer will be informed by e-mail. Furthermore, the company AIX ET TERRA reserves the right to refuse any order from a customer with whom there is a dispute.
8. Litigation
This contract is subject to French law. The company AIX ET TERRA cannot be held responsible for damages of any kind, whether material, immaterial or corporal, which could result from a malfunction or misuse of the products marketed. The same applies to any modifications to products resulting from manufacturers. The responsibility of the company AIX ET TERRA will, in any event, be limited to the amount of the order and will not be held liable for simple errors or omissions that may occur despite all precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of: a professional association in the sector, a consumer association or any other advice of his choice. It is recalled that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the discretion of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honours his financial commitments to the seller. Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution. Failing this, the Commercial Court of Romans is the only competent court, whatever the place of delivery and the method of payment accepted.
9. Quality Assurance
If, despite all the precautions taken by AIX ET TERRA in the manufacture and selection of products, you should encounter a hidden defect relating to quality, we thank you for informing us as soon as possible so that we can take action and make the necessary corrections to replace the product or reimburse you. For information, our products are subject to expiration, including gifts on their packaging a "DLUO" (To consume preferably before) variable according to the products from several months to several years. These products remain edible at this date without food risk but may have lost their taste and nutritional qualities.
We would like to draw our customers' attention to the importance of storing products away from heat, humidity and excessive light.
Non-compliance with these storage standards may not constitute a cause for complaint, AIX ET TERRA declining all responsibility in this case.

10. Legal information
The personal information collected for the purposes of distance selling is mandatory, this information being indispensable for the processing and routing of orders, the establishment of invoices and warranty contracts. Failure to provide this information will result in the non-validation of the order. In accordance with the law "Informatique et Libertés", the processing of nominative information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). The customer has (article 34 of the law of 6 January 1978) a right of access, modification, correction and deletion of data concerning him, which he can exercise with the company AIX ET TERRA. Moreover, the company AIX ET TERRA undertakes not to communicate, free of charge or with consideration, the details of its customers to a third party.
Minors: under Order No. 59-107 of 7 January 1959 and Act No. 74-631 of 5 July 1974, the sale of alcohol to minors under 16 years of age is prohibited. Any person ordering wine or beer or any form of alcoholic beverage from the company AIX ET TERRA therefore undertakes to be over 16 years of age on the date of the order.
